1. Agreement to Terms

By accessing or using www.dynamomethods.com, our software, or related services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use our Services. By using the Services, you represent that you meet this requirement.

3. Use of Services

You may use our Services only for lawful purposes. You agree not to:
- Reverse engineer, copy, or attempt to extract source code from our software.
- Use the Services to transmit spam, harmful code, or unlawful content.
- Resell, sublicense, or exploit the Services without our prior written consent.

4. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Fees & Payments

Some Services require payment. Prices are provided at checkout or in your subscription agreement. You authorize us and our third-party payment processors to process payments via your chosen method. All fees are non-refundable except where required by law.

6. Intellectual Property

All content, software, trademarks, logos, and frameworks associated with Dynamo Methods are owned by or licensed to us. You may not use our intellectual property without express written permission.

7. User Content

You retain ownership of content you upload to the Services. You grant us a limited license to use, host, and display such content solely to provide the Services. You represent that your content does not infringe the rights of third parties.

8. Communications

By creating an account or providing contact information, you agree to receive communications, including marketing emails and SMS, subject to applicable law and your opt-out rights (see our Privacy Policy).

9. Third-Party Links & Tools

Our Services may link to or integrate with third-party websites, tools, or services. We are not responsible for their content or practices.

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Services will be error-free, secure, or continuously available.

11. Limitation of Liability

To the maximum extent permitted by law, Dynamo Methods shall not be liable for indirect, incidental, or consequential damages. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid to us in the past 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dynamo Methods, its affiliates, and employees from claims, damages, or expenses arising from your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Kansas, without regard to conflict of laws. Disputes will first be attempted through informal resolution. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, except claims eligible for small claims court.

15. Changes to Terms

We may update these Terms from time to time. Updates will be effective upon posting. Continued use of the Services constitutes acceptance of the updated Terms.
